Disputes arise about entries on credit card accounts.

I have an ongoing dispute with MBNA International Bank Ltd, which is now 29 months old. To cut a long story short, I bought a video camera in the US and paid by MBNA Visa. The salesman had lied to me about the specification of the camera and within 1 hour, I had returned it but he declined to accept it. Eventually, after a lot of aggravation from MBNA, I sent them the camera and they credited my account. However, in the 2 years that it took to get to this point, they were adding interest for the value of the camera, to my account. I have declined to pay this interest, for obvious reasons. Despite being able to prove to them that the only monies outstanding on my account is the interest applied to a value which they have since credited me with, I have recently received a letter stating that the information has now been "registered with the Credit Reference Agencies". I have an impeccable credit history and am a retired Police officer. I will not be bullied into paying this money, because I do not owe it!

MBNA are not in the banking ombudsman scheme, but are covered by the complaints scheme of the Finance & Leasing Association. I suggest you first write to MBNA telling them that you are going to complain to the FLA and give them a week or so to react. Sometimes the prospect of a complaint to an outside body and concentrate a financial institution's mind.

Another complaint about MBNA

Just over a year ago I applied for a credit card with MBNA after
receiving an unsolicited application form but they declined my application "for lack of information". (The form was fully completed.) Despite this the credit cards arrived, but met with problems from Day 1 because they got my banking details wrong and were requesting money from someone else's account. The card was used for a monthly recurring payment which was
terminated in September of 2000. Following this I terminated, in writing, my agreement with MBNA. They maintained a balance was owing and continued to apply for the money from my account, which had been stopped previously.

When I returned to the UK I contacted MBNA and tried to sort the mess out. Eventually I managed to get them to agree to waive the charges and I should pay the disputed amount which was 9 pounds 11 pence sterling. The cheque was cashed by MBNA on the 20th of December 2000. I have since had a letter stating they have placed me on the bad debtors list with the Credit Reference Agencies. My financial position is strong, I do not owe any money, even on a mortgage, and I have hardly used credit in the recent years.

Our reader will now

  1. Get a copy of his credit reference agency records and see what they say.
     
  2. Then write to MBNA quoting what they have put, stating (if they have made an adverse entry) that they have libelled him and he
    wants them to cancel the entry and compensate him.
     
  3. He can also add your comments against the credit reference agency entries. Equifax and Experian will tell him how to do this.
 

Yes it's MBNA again

I visited your site for the first time 01/06/01 looking for inspiration into a problem I am having with apparently one of your favourite credit card companies, MBNA.

On the 23/02/01, I purchased two tickets for my wife & daughter to see a Robbie Williams concert at the Old Trafford Cricket Ground Manchester, which will take place on the 28/07/01 Using my MBNA credit card. Total value £110.00.
I booked these tickets through a local travel agent, Aytons Travel who ordered said tickets from a company called Portfolio Enterprises Ltd. This company has gone into liquidation.
I have contacted Aytons Travel,Trading Standards, ABTA & MBNA, via telephone & letter all have expressed their regrets.
After two weeks of letters,telephone calls & lots of information, MBNA I believe are now the only multi million pound company who can refund my full purchase price of £110.00. Their latest communication dated 29/05/01 states that they do not believe that they are in contravention of the Consumer Credit Act & would be interested to receive confirmation of which section they have breached. TRY SECTION 75.
To sum up I am £110.00 out of pocket plus telephone calls, plus letters & postage, plus time, plus ear ache off my wife & daughter for a concert that I have paid for, that they will not be able to see due to obtaining additional tickets is like obtaining rocking horse manure.

Payment arrangements on Egg credit cards - a reader writes

When signing up you have three choices, direct debit all of outstanding balance, direct debit set amount, or direct debit minimum amount. Other methods are also available for paying off the balances etc. including BACS (no charge from Egg for using this).

However... a D/D from your account will be credited to your account on the same day. A BACS payment however may take ten days from leaving your bank account to being credited to your Egg account.

When I queried the latter, I was told Egg is not a clearing bank, so they use HSBC for this purpose. Consequently a BACS payment takes 4 working days to clear to HSBC, then 4 working days to clear to Egg, and then Egg take a couple of days because of internal admin to credit it. My bank is First Direct - part of HSBC. Egg thus tell me it takes HSBC 4 days to clear funds from HSBC to ... errr... HSBC. Then 4 days to clear it to a non-clearing bank (eh?). Then, whatever happens with the above, they sit on the money for two days. When I queried HSBC about the 4 days clearance from HSBC to HSBC they did not reply. I no longer use Egg. Halifax offer 1% cashback as well.
